Legal Question in Employment Law in Virginia

Brother in Law is a plumber, he is On Call a couple times a month. The company does not compensate him unless he responds to a call. This requires him to miss out on family events etc so that he is in the service area at all times.

Is this legal to hold someone down w/o compensation?
