Legal Question in Employment Law in Virginia

Certification requirements

My company just issued a policy for members of my organization to obtain a previously not required a specific certification to maintain employment. They insist that the time and cost to study for and obtain the certification come out of the employees own time and money. They will pay the cost of the certification exam if passed.

If not certified with in 12 months employment will be terminated.

Is this legal?
