Legal Question in Employment Law in Virginia

Cheated By Management

The city that I work for implemented a pay study. The decisions of the consulting firm was what the city was going to go with. During the study, I submitted info about the position that I worked. During the study (Sept. 2001), management changed my position. The results were to be retroactive July 2000. When the results came in, management advised me that my position was approved to be reclassified but because they changed it, it did not apply. All of the other positions were upgraded according to the pay study. Do I deserve back pay? Not only that but what I am doing now has more responsibility than what I did then. What legal recourse do I have?

Re: Cheated By Management

Your recourse, if there be any, is most likely contained in your contract of employment with the city or collective bargaining agreement. (If the latter applies, you should be talking with your unuion representative.)

If you are not working under at least one of the above, with specific clauses protecting you from the type of adverse actions which you have described, you are most likely without any remedy.
