Legal Question in Employment Law in Virginia

I am ''Power of Attorney'' for my son whom has been incarcerated. He was employeed up to the date he was put in jail. He was due a two week paycheck 3 days after and still had another paycheck to come for his 3 remaining days. His employer has still almost 3 months later refused to release his paychecks to me. He claims as my son acknowledges signed paperwork to initiate health insurance on the April 6th and then went to jail the 7th and will not be out for 8 months. He won't release his money because he still owes for the insurance. He was told on the 7th that he was incarcerated that he would be there at least 2 months. His children are on Medicaid and with him in jail, why would we want to continue to pay for medical ins. What steps do i need to take to get this money from them?

You would probably be best advised to wait until your son is released and allow him to pursue the matter with his former employer by initiating a suit in small claims court, if the employer continues to refuse to pay up.
