commsioned employees and credit card fees

my employer has recently started penalizing my commisions when a client pays with a credit card. he says it is to defray the cost of accepting cards. he splits the 4% fee in half and takes that from my final commision. on a 10,000 dollard job, i usually clear 1000. now if paid by credit card, a fee of 400 is charged to the comany and 200 dollars of that comes off my commision.

I see nothing amiss in this action attributed to your employer unless you're working under the protection of a contract which would specifically prohibit such action on the part of your employer to curtail the amount/size of your commissions.
