Can an employer place an employee on Leave Without Pay status for missing work while complying with a District Court subpoena to appear as a witness?

Normally, an employee who is required to appear in court under a subpoena is suppose to receive his or her regular pay for that day from the employer less any fee the person may receive from the court as a witness.
