Legal Question in Employment Law in Virginia

My daughter has court ordered visitation and her job is telling her that she will have to resign, is that legal. We live in Virginia and her father lives in Georgia. She let her job know during her interview that she had to go to her dads for visitation. Now that the time is here, they are telling her they have to lay her off or she could resign so she is eligible for rehire.

Unless your daughter is working under the protection of a contract which says otherwise, the position taken by the company on this issue would not appear to be violative of any law of which I am aware.
