Legal Question in Employment Law in Virginia

disloyalty to the company

i work full-time for a rehab staffing agency.my employer sends therapists into all areas of need, including home health. a competitor has offered me temporary home health work, i would be seeing home health patients for him after i get off from my full-time job. is that considered disloyalty to the company? my contract says i could be fired for disloyalty to the company. i also have a no-compete clause, saying i cannot go to work for any company they have placed me with for temp staffing, but my employer has never placed me with this competitor.

Re: disloyalty to the company

Working for a competitor company in one's off hours(without permission from the primary employer)) could, I believe, certainly be construed as disloyalty to the latter employer and, therefore, a grounds for termination.

But, of course, in order to be sure, you could always ask them as to their position on the issue.
