If I "Earn Vacation time as I work" but in the personnel policy it states that with notification of 2 weeks at the discretion of the supervisor...are they permitted not to pay me upon termination? I was told that I could fight it in court and win

Yes, the company can refuse to pay you upon
your termination under the circumstances described (in my opinion).
