Legal Question in Employment Law in Virginia

I am employed by the federal government and am currently interviewing for a position outside of the governemnt. I signed a recruitment incentive agreement for one year. The agreement states the exact dates from July 4th 2011 to July 3rd 2012. It says that I must "remain an employee of the federal government for one full year (26 bi-weekly payperiods)". During this year I had a baby and was forced to take leave without pay. I looked everywhere to find out how that might effect my service agreement term. In the Code of Federal Regulations it states that the service agreement "may address the extent to which periods of time on detail, in a nonpay status, or in a paid leave status are creditabe towards the completion of the service period". My service agreement did not address this. I don't want to ask the HR department because I am not ready to give my notice and would prefer them not to know.

So, if it's not addressed in your service agreement, then a reasonable argument

should be makeable that the leave you took with out

pay should not be a factor in your completion of the agreement.
