Employee Firing

can a full time waitress be terminated for not forfilling her duties. When she has never had anything in writing as to her duties.This particular person is doing everthing possible to neglect their duties. AS there are two employees engaging in this same activity (or non activity) would terminating them result in unemployment compensation.

No, not if you can demonstrate to the satisfaction of the Commission that their respective terminations were "for cause", i.e., justified.
