Legal Question in Employment Law in Virginia
If an employee is out from work for a medical problem (metal, emotional, and/or physical) how long must an employer wait for the employee to return to work. (Assume employee obtains all medical excuses from doctor(s) and the employer recieves all of the medical excuses.)

Unless the employee is working under the protection of a contract or collective bargaining type of agreement, s/he can likely be terminated at any time without any adverse consequences to the employer. (Whether such a terminated employee would be eligible for unemployment benefits would likely depend upon the particular facts invovled and whether such facts allowed for a "just cause" or similar determination by the VEC).
