Legal Question in Employment Law in Virginia
An employer emails an unsigned Word (or PDF) employment contract to me. I do not agree with one of the terms of the contract. So, I modify the terms, sign the document, and email the contract back to the employer. The employer signs the contract without reading it and sends the signed copy back to me. Is the contract binding? Am I required to highlight the change or is it the employers responsibility to read the contract before signing it?
1 Answer from Attorneys
The employer (if he chose) could likely move for recission of the contract on the grounds that what he actually signed was a counteroffer which he had not understood at the time and which was therefore invalid since there was no true meeting of the minds of the parties.
