Legal Question in Employment Law in Virginia

If an employer does not give employee benefits they were eligible for even after being reqested by employee 4 times (ie: short term disability), THEN the employee gets injured and has to be off work, is the employer liable for anything? Should the employee get paid by employer since the employer failed to give requested benefits to employee?
