Employer not giving days off

Requesting days off from employer.

No personal or vacation days are left.

Employer is unwilling to give leave without pay.

Employer is insisting on suggesting resignation to take the leave.

Employment is for a public school.

Is this legal?

Why wouldn't it be, unless you're requesting the leave under the Family & Medical Leave Act(FMLA),

under a provision of your contract or collective bargaining agreement which allows for such leave

(if there be such), or, perhaps, by virtue of an accepted pattern of practice in your school in the past which has allowed for such leave taking by employees on a more or less regular basis?
