Legal Question in Employment Law in Virginia

Can a employer make you claim more tips than you earn in order for you to get a check. I make 2.13 hr plus tips. I claim all I earn, but the employer make me claim more monies than I earn or they hold my check.

No, such a practice cannot be legal and you may want to consider filing a complaint with the Virginia Department of Labor & Industry(VDLI), Employment Division's Wage and Hour Section and request an investigation.
