Legal Question in Employment Law in Virginia

Can a former employer come after you for overpaying your severance? I have been separated from them for 1 1/2 years and they say they overpaid my severance and want it back ($1600). When I received the extra severance, I phoned to make sure it wasn't a mistake, and their representative (who no longer works there) said it was correct.

Sure they can "come after you for (allegedly) overpaying your severance."

However, whether such could be credibly proven in a court of law by a

preponderance of the evidence is quite another matter.
