Legal Question in Employment Law in Virginia
My employer never took payments out of my weekly paycheck to cover health insurance through the company. I had always assumed it was being taken out because I had health coverage for about 2 years. They discovered one day even though payments were being made to the health insurance carrier they just weren't being deducted from my check. I have since cancelled my coverage however my employer says they have to deduct payments from my check now to pay back what should have come out. The total they gave me is 3000. I feel it was my employers fault not noticing the situation and I shouldn't be responsible for this. Can they legally collect this money from me and if so can they do it in this manner?
