Legal Question in Employment Law in Virginia

Employer not turning pay amounts to Disability Insurance

I worked for a company and purchase a Disability insurance throught them. It was suppose to help maintain the lifestyle we are in at the time of Disability. When I became disabled my company had not been turning in quartley amounts correctly. When I became disabled I was making 12.69 and hour. When the insurance co notified me of the amount i would recieve it only equaled to 1071.00 a month I was making more than that. The insurance company can only go by what the employer sent in. When i asked the woman at human resources she admitted she hadnt turned it in. I am Perm Disabled. Can I sue the company for not doing there part in the insurance. I became disabled June 16 2000. by my calculations I should have been recieving 2284.00 a month before taxes or even after taxes on the 2284.00 is a long ways away from 1071.00

Re: Employer not turning pay amounts to Disability Insurance

If your disability insurance was purchased under terms that obligated your employer to do certain things which they failed to do and which therefore caused you to incur damages, you would appear to have a legal basis to bring suit to recover your losses.
