Employment Agreement Contract
To whom it may concern:
I was part of a reduction-in-force effort by the company in which I was employed. After this loss in my employment, I had earned approximately 60 hours of vacation pay. When I did not receive the pay in my final pay check, I inquired with the human resources department. They advised me that they were not legally obligated to pay me due to the guidelines provided by the Service Contract Act.
However, I have an employment agreement contract that states otherwise. Furthermore, I was told that they would not honor the contract that they sent to me and signed because it did not have presidence over the Service Contract Act.
However, through various sources, I have been advised that an employment agreement has more presidence than the Service Contract Act.

I believe that that the information that you have received regarding your personal employment contract taking precedence over the federal Service Contract Act with respect to this particular issue is correct.
The Service Contract Act applies general guidelines to private sector businesses which contract with the federal government for the supply of goods and/or services. It is not designed to preempt the right of individual employers and employees to contract to establish
the conditions or terms which are to govern a particular employer-employee relationship.
