Employment -FMLA

Where does an employer have to indicate that an individual is a key employee to the organization. It is my understanding that employees designated as key may not benefit from FMLA.

Yes, employees in a managerial capacity have more limited rights under the FMLA than those enjoyed by regular non-managerial employees. As an example, the former have no guarantee to reinstatement to their former positions or ones similar with similar compensation as do the latter.
