Legal Question in Employment Law in Virginia

In May 2008 I accepted an offer with a company, which included a 2 year commitment, and a relocation alotment. Last week I recieved notification that due to the economic downturn the comany will be closing and my job will terminate in Jan 2009. I have been informed that if I find a new job and leave before Jan I will be liable for a prorated portion of the relocation package. If I find a new job and leave before Jan should I just take my chances on whether or not they'll pursue me?

If the company will be going out of business in January 2009, it's unlikely that they would be pursuing you for this prorated portion of your relocation alotment(in my opinion).
