Legal Question in Employment Law in Virginia

Employment Law

My husband employer just notified them today that effective 4/16/08 salaried employees will be made hourly with no overtime and only clocked hours being paid for unless leave time is used. Can he legally change an employees status for days which have already passed? I didn't think you could make policy changes retro-active as those days worked were done so under the old policies, and employee status
