Legal Question in Employment Law in Virginia

employment termination of US citizens verses B1 classification employees

Employment is terminated for US citizens. B1 classification legal aliens were not terminated (downsized). Do we have any legal recourse? Should the company terminated the B1 classification people prior to termination of US Citizens?

The answer is no to both of your questions. There

is no legal requirement that private employers

must give preference to U.S. citizens over holders of B1 visas(non-immigrant)in deciding who first gets the ax, absent exceptional contractual

provisions which in all probability do not obtain

in your case.
