Legal Question in Employment Law in Virginia

Equal pay for equal work?

Is this law only geared towards discrimination (Sex, race, ect) or is it for everyone? My situation is as follows. I was hired into a company 2 years ago in the Monitoring group at a T7 pay level. In the 2 years that I have been with the company I have received 2 excellent yearly evaluations. The current economy has affected the company and there have been numerous layoffs to include my entire Monitoring group. My skills were noticed and I was moved to the Systems Administrator group. This happened about 8 months to 1 year ago. I was moved without a promotion or a raise. I am doing the same job as my coworkers but I am 1 to 2 pay levels below them and I am making anywhere from $25000.00 to $40000.00 less. Is there anything that can be done?

Re: Equal pay for equal work?

Are you working under a contract that provides specific guarantees that you will be compensated

at the same level as any other co-workers who are doing essentially the same or similar job that you are or have been doing?

If not, other than going to your immediate or higher supervisor(s) and making your mind known to them on this issue, the answer is no, there isn't.

The Commonwealth of Virginia is a so-called "right to work jurisdiction" where, absent

a specific contract guaranteeing their rights and protections, employees working for private companies have few such rights and protections , and virtually no remedies to counteract adverse employer actions against them such as the one which you have described.
