Legal Question in Employment Law in Virginia

Fired while sick

I was wondering if I have a case agianst my former employer who termintated my employment while I was out per doctor's orders??

I did have words with a fellow employee before I went out sick, which is why I believe I was fired. A person who had called my home and began swearing at me and called me a liar. When I reported it to the VP, he said ''what no one ever swore at you before?''

The next day I was told to stay out of work for stress related illness. I was to return on 3/15/04 and was sent a fed ex on 3/11/04, terminating my employment.

Re: Fired while sick

Unless you were protected by an employment contract against such summary action on the part of your ex-employer or you had properly filed for leave under the Family & Medical Leavr Act(FMLA) prior to your dismissal, I would say no.
