Legal Question in Employment Law in Virginia

Fired Unjustly

I was fired because I was involved in a incident. Another employee attacked me and I was injured as a result. The other employee had the wrong person the whole time. I was told the state agency will not tolerate this behavior. There were other physical fights overlooked by them prior to me working there and both partys are still there. The other employee was also involved in a prior incident. This behavior "was" tolerated and as a result I was injured and lost my job. Should'nt the agency be responsible?

Re: Fired Unjustly

Virginia is an at will employment state which means that an employer can firs you for any nondiscrimnatory reason. Examples of discriminatory reasons would be firing due to race, gender, or disability, national origin.

You may have contract law rights depending upon whether you have a contract with your employer regarding grounds and procedures for termination. Procedures set forth in an employee handbook can constitute a contractual agreement. You should consult an attorney.
