I work for the state of va in health care setting have worked for state 5-years during that time Ive been hospitalized twice and have had numerous er and md visits due to malignant htn and migraines now my md excuses dont count and i'm being written up when personel was well aware of my condition but never once offered or counceled me about FMLA now Im filing a greivance against the write up for absenteeism ,do I have any other recourse asked to view my file nothing negative noted

I doubt that your personnel department could be faulted for failing to advise you as to what your FMLA rights might have been during your periods of absenteeism from work when you yourself apparently could've made the effort to investigate your eligibity for FMLA leave and applied for such leave for any of those time periods.
