Legal Question in Employment Law in Virginia
Gap Time
We are on a 28 day pay cycle, which requires 171 hours before any overtime is paid. We recieve abosolutely zero compensation for hours worked between 160 and 171. Our hourly rate is based on 40 hours per week/160 hours per 28 days. However, if we work 171 hours we get paid the same as if we work 160. I would like to know if there are any cases that would help us recieve pay for all hours worked.

Re: Gap Time
You're premature in your request(for case law). You need to find out first(if you haven't already done so) precisely what your employer's explanation is for not compensating you for these 11 hours.(If the explantion is to be found in what you've described in your question, I fail to see it.)
