Legal Question in Employment Law in Virginia
giving notice while out on FMLA
I am currently on FMLA for the birth of my son, with 5 weeks of leave time left. Due to the nature of my job, my company has needed to replace me temporarily while I am away. I have just been offered another job that I would like to take. Due to my current position, I feel it necessary to give a four-week working notice (though I believe I am required to give a two-week working notice in order to be eligible to work for the company again). If I were to give my notice now while on leave(instead of waiting until the end of my FMLA) so I could start the new job sooner, would that be considered a ''working notice''? Thank you. Any advice you could offer would be appreciated.

Re: giving notice while out on FMLA
Why wouldn't it be a "working notice" and a more than adequate one at that?
