Can my employer add a 20% gratuity for the ''convenience'' of the customer and only pay me 17% of that, keeping 3% as ''misc. income''?

Yeah, unfortunately, the reality is that he could probably get away with keeping the 17% for himself (as miscellaneous income) and giving you the 3%.
