Legal Question in Employment Law in Virginia
Hepatitis in the workplace
I work at a small restaurant in VA., Friday I was told I would have to work with aco-worker who is believed to have Hepatitis. I told my boss I did not feel comfortable working with this person, due to the fact that he had open cuts on his hands, also that I did not feel that he should be handeling food. I was given the alternative of losing my job or working with this person. I chose the prior.
is there any legislation stating that this person should not be handeling food, or was I in the wrong.

Re: Hepatitis in the workplace
There are different kinds of hepatitis with differing degrees of transmissibility, depending upon various circumstances and factors. I know of no Virginia law which absolutely prohibits a person having any kind of hepatitis from handling food destined for public consumption. You may wish to contact discretely your local health department who may be able to further advise you on this matter.
