Hiring Practices

My husband was employed as an assistant manager to be paid $500 per week while training plus commissions. After he'd been with the company for two weeks he learned that he would have to work as a salesman and make so many sales prior to obtain the assistant mgr. position (this was not originally explained to him). He was also told that in order to obtain the $500 training salary he would have to remain with the company for one month and he would have to make a specific number of sales calls per week. Because of the deceptions in his hiring and the deceptive sales tactics he was told to do, he left the company after 2 1/2 weeks. He was actually told to do certain things to obtain sales that resulted in him actually netting zero as commission. . .none of this was explained as to how it would impact his commission check. My husband supposedly signed an employment contract but he was never given a copy of it and I've been told that it is confidential and they won't release it. Can they (company headquartered in TX but does business in VA) withhold a copy of this signed contract from us? And are they liable for any of the monies due to what my husband was told verbally about his pay?

Without a copy of the contract, it's impossible to say what rights your husband may have in this matter and what monies, if any, may be owed him by the company.(Your husband should've immediately demanded a copy of the contract once he signed it, and if his demand had been refused, walked out, then and there.)

The company can continue to refrain from releasing a copy of the contract to your husband until a lawsuit is filed(which could be expensive)and a lawyer serves them with a subpoena to produce it.
