Legal Question in Employment Law in Virginia

I am an huorly employee that must be "on call" one weekend a month. There is a possiblity that I will not have to work or I could have to work 10 hr days. However, I do not receive any days off for that wknd so I am expected to work 12 days straight once a month. Is this right?

If you are paid as an hourly employee, according to DOL (U.S. Dept. of Labor)

rules, you must be paid time and one half compensation for all time worked

in any given week which exceeds 40 hours.

If such is not happening in your case, you could then file a complaint with the

wage and hour board of the labor and employment division of the Virginia

Department of Labor & Industry(VDLI) and request an investigation.

You could also file a complaint with DOL and also request an investigation.
