Legal Question in Employment Law in Virginia

Husbands 3 day suspension?

My husband had a work related injury and was off on workmans comp. from Sept. 08 til June 09. He had been back at work on his 3rd day and his boss informed him he was suspended for 3 days because of a job related issue from Aug. 08 that he was never informed of until this day? This just seems like some form of retaliation to me. He in this guy have had problems in the past. I just don't understand how you can punish someone for something that happened almost ago...that they were never even informed that it was an issue in all this time? Thank you

Re: Husbands 3 day suspension?

If it's unrelated to your husband's claim for workman's compensation and your husband is working without the protection of a contract of employment or collective bargaining type of agreement under which he could contest the suspension, he is, unfortuantely, very likely without recourse with respect to this three day suspension.
