Legal Question in Employment Law in Virginia

Illegal Practices?

I work in the medical field (not a hospital and not under contract). I was curious if the doctors pay roll rules are illegal.

- No overtime is paid. No matter what time we get to work or what time we leave (even if patients are there and we have to stay) we are not allowed to clock in before 8:30 or clock out past 5:30.

- Lunches. Whether we get a lunch or not it is mandatory that we clock out for an hour. If we don't clock out - it is taken out automatically through payroll

The doctor wrote these ''rules'' up, faxed it to the employees and told us to sign it.

Re: Illegal Practices?

The doctor may not be following the rules mandated under the Department of Labor's Fair Labor Standards Act (FLSA) which require that all nonmangerial, salaried employees be compensated at a rate of time and a half for all hours worked over 40.
