Legal Question in Employment Law in Virginia
injured at work
Hi,
My daughter was working and the store was closing. Two coworkers were at the door waiting for my daughter to get her purse from the back room and get out before the alarm timed out. On her way up the aisle as she was walking briskly to hurry because of the alarm, she tripped and fell. she assumed she tripped over her own feet. The manager on duty did not fill out injury form just asked did she fall. I took her to the ER and they put her on crutches and pain meds and said follow up with orthopedic DR (which we did the next day) He put her in a boot and told her to stay off it. That was a month ago. He also stated he will want to do a MRI once the swelling is gone, and possibly physical therapy. During the first week I contacted the company she works for and they filed it with workman's comp. They denied the claim. My question is: Is there anything I can do about her having to be off and losing pay? What about all the DR bills? Does she have any rights to be compensated since she fell on the job? By the way, my daughter is 17.
Thanks

Re: injured at work
If your daughter's workmans's compensation claim was denied, the denial can be appealed (and should be, under the circumstances which you've described).
