Legal Question in Employment Law in Virginia

Job Elimination

I was employed with a company as the I/T Manager. My position was eliminated Oct of last year. I have just been informed that they have now recreated the position and hired someone into it. My question is this. Don't they have to offer the job to me if they decide to fill it within 18 months of the elimination? What legal recourse do I have in regards to this?

Virginia is a so called employment-at-will jurisdiction where employees have few rights and protection unless they are working under an employment contract or collective bargaining agreement. Unless you had such a contract or agreement which specifically provided for the type of rehiring provision to which you've referred, I do not see any realistic legal recourse available for the situation which you've described.
