Legal Question in Employment Law in Virginia

I was let go from my job,I was under FMLA for around two weeks ,2/16/17 my boss texted me and ask if I was coming back on Monday, Feb 20. I replied not sure I go to the doctor on Friday, 2/17. I will let you know after my doctor's apt. I got a text again from my boss stating I could not come back to work while taking my meds. I told the doctor and he said I could try and go back and just take my meds at night. Doctor wanted me to come back in two weeks and if sooner if I needed to. This was on 2/17. I went into work Monday morning and they told me I no longer work for the company and my employment had been terminated. They read a paper to me stating that I could resign or be terminated but they were going to give me 13 weeks severance pay either way. I made no statement. They asked me for my keys and phone. Then they handed me an envelop and wished me well. Told me not to come back on the property or to have any contact with the employees. I walked out. I got home. There was a check in there dated for 2/17 (which I was under FMLA). What is my legal rights at this point?

I would suggest that your arrange for a consultation with an attorney who is appropriately

experienced and knowledgeable in the federal law governing FMLA amd who should be able

to advise you on the merits of your claim and the option that you may wish to

pursue in U.S. District Court for this alleged violation of federal law by your

former employer.
