Legal Question in Employment Law in Virginia
Labour and Employment
I am working on a valid H1 visa in the US for the past 5 months.Initially, the present company i am working with told me that i would have to pay the amount they incurred to transfer my H1 in the event of my leaving the company within a year.
My current company is now being taken over by another company and i am not sure whether i would be absorbed by the new company.
Since i am on an H1 and i cannot be in the US the next moment if I dont have a job,i have decided to quit. Now the HR manager has reminded me about that money. This quitting decision was not mine and i was forced to take it.
I would like you to help me on this.what should i do? Should I have to pay the money?

Re: Labour and Employment
Quitting now before your current company
is taken over would be ill-advised unless you have another company immediately available to sponsor your H1B status. And, yes, doing so would also require you to honor the terms of your agreement with your current employer regarding compensating them for the cost of transferring your H1B
visa as a result of your premature termination(if such was part of the agreement).
