Legal Question in Employment Law in Virginia

Left prior employment in 12/2009 with them still owning 25K back pay to me. It is now 9/2010 and the employer is stating they will take me to court for looking at sexual content on there companies computers and trying to exchange sex with other individuals (no money exchange) using there computers. Can they take me to court for that? would it play any role in a case I would have to try and get my back pay?

Unlikely, but might reduce your claim against this company by a few thousand

dollars as an offset against your claim against it premised on a theory, perhaps, that you were not engaged in productive work while you (allegedly) whiled away X number of hours at the expense of this company looking at pornographic websites.
