Legal Question in Employment Law in Virginia
Is it legal for a private security guard to require a contractor to "surrender" his ID (driver's licence) in order to work on private property? Thus leaving the individual with no ID in his possesion.
1 Answer from Attorneys
So where does the request for such a surrender originate, i.e., with the guard
or with someone higher up? If it's merely from the guard, the contractor should refuse to surrender his driver's license. ( Such a request should involve no more than showing the license.)
However, if this kind of request originates with an individual higher up in the
chain of managerial authority, the contractor should get the name and contact
information for this person to find out the reason for the request and whether
he can be exempted from it.
