Legal Question in Employment Law in Virginia
Is this Legal?!?
I'm writing on behalf of my mom. She's working as a nanny (babysitter) full-time. When she started working with her current family, they paid her $10/hour for 3 children, two of which were over 6 yrs old. and a toddler, at the time of employment. The basics of her job were to just take care of the children from 8:30 am-5:30 pm. Over the last year, her labor has increased amazingly. They're making her do the laundry, cook, clean, vacuum, take care of the pets, organize the household, etc. They had another baby, making four children. I'm not even mentioning that these children always have their friends come over...making the house seem more of a daycare than a house. Not only that, but sometimes the employers come home at 6:30pm...and they don't pay overtime (Not to mention that they also call her in earlier at times). So labor was added, amount of children were added, but her salary remains the same...without overtime. To me, this is not a babysitter...this is a maid/servant. This seems very unfair and labor-wrong. So i would greatly appreciate it if you would e-mail me back at [email protected] telling me what you think about this issue.

There's nothing illegal about what you've described, Victor; your Mom should negotiate a better pay arrangement or look for another employer who is willing to pay her what she deserves.
