Legal Question in Employment Law in Virginia
non compete clauses
Greetings,
I work for a media group and the station that I sell for is changing formats. The GM of the group came to me and told me I had two options, either sell for another station in the group or find another job somewhere else. We all have non competes, but are in essence being let go from the stations we sell for. When I asked the GM if we could be let out of our non compete, he said no. I feel as if my hands are tied. They are making us go to one of the other radio stations, leaving behind all we have established or leave to find a job outside of the field I am in. Is there any recourse I have?

Re: non compete clauses
Unless, somehow, the station's action violates your terms of employment(if under a contract)or
is inconsistent with the terms of the non-compete agreement itself, or, in the alternative, the non-compete agreement is itself invalid on its face(due to unreasonable time and/or scope considerations), I'd surmise that you and your fellow disgruntled employees are probably stuck with it.
