non payment of wages in virginia

my employer claims to have no money for payroll and says there is no intent on paying the wages earned for the last two weeks of work i believe the owner to be not so honest and want to know what i can do to get my wages earned the intent is to close the facility in two days and they have told no one only a few of us know. what can we do?

If the company doesn't pay you after you've earned the money, you could sue them or their representative(s) in small claims court.
