Legal Question in Employment Law in Virginia

Non-compete agreements

I was recently ''let go'' from my position as Staffing Manager for a large company. I was a good employee who even placed 5th in the nation for incremental sales growth in 4 months one month prior to my termination. I would still be there pursuing my career if I was not terminated. My questions is: Will a non compete agreement stand up in court? I never signed anything stating that my job was in jeopardy from my performance and every time I met with my manager she only stated that I did not seem happy with my position. Untrue! Which I told her often.

I can find a job immediately in that field which is what I desire to do bc it is what I am trained in, I am also very good at it. Her only reason for firing me was that I didn't seem happy. That was her paranoia. My personality just did not fit into the office. What can I do?

Re: Non-compete agreements

Your question as to whether a non-compete agreement will stand up in court must be answered

with a yes, most definitely, if the agreement is

reasonable within its scope and time limitations.

And if your former employer has been using these

agreements for some time, it probably is, and

you are, therefore, obligated to abide by the terms of the agreement until its expiration. MH
