non-compete enforceable with bounced checks?

I have a non-compete with my current

employer, but I have had more than one

paycheck bounce, have had 401k

money withheld and magically appear in

my account much later, and had my

health and dental coverage lapse

because of my employer not paying

premiums. I assume that my non-

compete is null and void due to all of

this garbage I've been put through. Am

I correct by VA law? I can't imagine that

it would hold up since VA is a Right to

Work state.

You could be very wrong in your assumption. The other items that you've mentioned might be adjudged as utterly irrelevant to the issue of your alleged breach of the noncompete agreement--

should you decide that you are no longer bound by the agreement.
