Legal Question in Employment Law in Virginia
Offered Job B, Quit Job A - then Job B Reneged. Now I'm unemployed (and 7 months
I was a hotel Director of Sales earning $45K. A new GM ''eliminated my position'' in Sep 2002. Unable to find a similar position (off-season, sluggish economy), I took Job B making $27K. In Feb, the hotel hired another DOS. 2 weeks ago, the hotel owner called asking me to come back. (I am 7 months pregnant, which he knew). We met for 2 hours; he offered me the job and agreed to pay me 6 weeks of maternity leave in lieu of a bonus I had been eligible for the previous fall. I offered 2 weeks notice at Job B (declined, as standard). I arrived for work Monday to find that the current DOS had not been let go. The owner asked me to meet him off-property, said the DOS was being let go and I should start on Wednesday. Tuesday at 9pm, he called to say another owner was not sure of the change the maternity leave being a big part of it. He acknowledged offering me the job and said he was embarrassed. (He is the operational partner and hires and fires regularly). We have met since but I am now going into my 3rd week of unemployment which I can ill afford, and my pregnancy makes finding another job really tough. Do I have any legal recourse? Although I didn't get the offer in writing, he told 2 sales employees I was coming back.

As long as there was nothing in writing, I see little prospect for any legal recourse available to you under the circumstances which you've described.
