Paid Time Off Leave

Is it illegal for companies not to pay employees their earned leave when they resign from the company if there is no written policy that addresses that?

No, since employers are in no way obligated to provide paid vacations to employees nor to compensate them for such accumulated leave upon termination, unless such is provided for in a contract of employment.
