Legal Question in Employment Law in Virginia

Not Paid for Time Worked

On December 26, 2005, I gave written notice to my employer of my intent to leave my position effective January 6, 2006. My supervisor contacted me by phone Dec. 27, 2005, and told me I was let go immediately. However, I was asked

to travel over 400 miles to return my company property. The next day, my supervisor contacted me and asked me to do some more company work to wrap things up. In summary, December 26th was a paid company holiday, I worked December 27 and December 28 ''wrapping things up'' for the company. (I have an expense report for that week that references my travel, etc). I also had two unused vacation days remaining and therefore expected to receive a regular 5-day check in my direct deposit today. I received no pay. Do I have any recourse?

Re: Not Paid for Time Worked

Your recourse is to call the company up(HR or whoever) to find out what's holding up the issuance of your final compensation. If that fails to produce the desired result, send a formal letter reiterating your demand with notice that you intend to report their dereliction to the Virginia Department of Labor and Industry (Employment Division)and then, if necessary, file a claim against them for your compensation in small claims court.

Then, if still no result, just do it.
